By visiting and using www.momentummeetsmastery.com or www.momentumelevation.com (hereinafter the “Website”), you accept and agree to be bound by these Terms and Conditions including our Disclaimer and Privacy Policy posted on the website and incorporated herein by reference.

The term “you” refers to anyone who uses, visits, and/or views the website. Momentum Elevation LLC (“company”, “I”, “we” or “us”) reserves the right to amend or modify these terms and conditions in its sole discretion at any time without notice and by using the website, you accept those amendments. It is your responsibility to periodically check the website for updates.

Your continued use of the website after posting of any changes to our Terms and Conditions constitutes your acceptance of those changes and updates. You must not access or use the website if you do not wish to be bound by these Terms and Conditions.

By checking the box next to this Terms of Use, and clicking the "Purchase" button, you as the student or client of Momentum Elevation and Momentum Meets Mastery products and services, whether through purchasing online, or opting in via the early bird option (hereinafter "you" or "Client") agree and willingly purchase entry into this program to be provided with services rendered by Momentum Elevation, and you agree you are voluntarily entering into a legally binding Agreement with The Momentum Elevation and Momentum Meets Mastery, inclusive of the following terms and conditions mutually agreed upon:

For good and valuable consideration as outlined below, the receipt and sufficiency of which is hereby acknowledged by all parties, Client is electing to purchase access to Momentum Elevation or Momentum Meets Mastery products. In exchange, The Momentum Elevation and Momentum Meets Mastery agree to provide the services outlined in the Program Outline below.

1. COACHING PROGRAM OUTLINE

a.) Client agrees and understands that he/she is purchasing access to either:

1. "One on One Coaching" by The Momentum Elevation, a program with twelve (12) weeks of curriculum designed to help you to improve your performance.

2. "Group Coaching" by The Momentum Elevation, a program with twelve or twenty four (12 or 24) weeks of curriculum designed to help you to improve your performance.

b.) Client acknowledges that he/she has read the Program Outline Addendum and conducted any additional research necessary to feel he/she understands what is being provided in Momentum Elevation Coaching Programs as well as what is not included. Client agrees to be bound by the terms and conditions outlined herein, as well as the general policies and procedures that can be found in this Agreement and on Momentum Elevation or Momentum Meets Mastery websites.

c.) If at any time Client is found to be disruptive, making disparaging or defamatory comments about Programs, Momentum Elevation, Hovhannes or any Momentum Elevation team members, or otherwise negatively impacting Program for others and hindering or distracting other Clients from their own success, Momentum Elevation reserves the right to remove such Client, without refund. Client understands this, and knows this is a risk if he/she elects to act in such an inappropriate manner. Client agrees this is a suitable remedy and action should he/she act in any of the ways outlined above.

Testimonials

a.) Client understands and agrees that any and all commentary provided within the "Momentum Elevation or Momentum Meets Mastery Communities" channels, a Momentum Elevation or Momentum Meets Mastery testimonial collection form, a conversation with a Momentum Elevation or Momentum Meets Mastery team member, and/or on public social media profiles belonging to The Momentum Elevation or Momentum Meets Mastery may be published and used as testimonials by The Momentum Elevation or Momentum Meets Mastery. Client gives The Momentum Elevation or Momentum Meets Mastery a non-exclusive license to use the copy as written inside all "Momentum Elevation or Momentum Meets Mastery Communities" channels, social media profile, in an email, in a form, or in a transcript of a call, or otherwise, and repost on The Momentum Elevation or Momentum Meets Mastery social media channels, in advertisements for Momentum Elevation or Momentum Meets Mastery or other similar channels for the specific purpose of promoting and showcasing Momentum Elevation or Momentum Meets Mastery client results. Client understands that he/she will have no expectation of privacy within the Momentum Elevation and Momentum Meets Mastery Communities platforms, and that any comments made may be used by The Momentum Elevation and Momentum Meets Mastery

c.) The material, Client's name, and other identifying information will likely be published on The Momentum Elevation and/or Momentum Meets Mastery websites, social media, or otherwise. No payment or additional services will be provided in return for Testimonial, and Client understands he or she is granting The Momentum Elevation and Momentum Meets Mastery an unlimited, irrevocable license in perpetuity to use, publish, distribute, or repurpose any information provided to The Momentum Elevation and Momentum Meets Mastery as part of a Testimonial.

Payment and Payment Plan

One on One Coaching

1. One-Time Payment: A one-time payment of three thousand nine hundred and ninety seven U.S. dollars ($3997) payable up front, in full, or;

2. 3-Payment Plan: 3 payments of one thousand four hundred thirty seven U.S. dollars ($1437) payable over 3 months, totaling $4311

Group Coaching

1. One-Time Payment: A one-time payment of one thousand nine hundred and ninety seven U.S. dollars ($1997) payable up front, in full, or;

2. 3-Payment Plan: 3 payments of seven hundred thirty seven U.S. dollars ($737) payable over 3 months, totaling $2211

a.) Client agrees to render payment via Credit Card on The Momentum Elevation or Momentum Meets Mastery sales and checkout page for One on One or Group coaching programs. Client understands that he/she/they/them is responsible for the full payment and agrees to pay the sum requested electronically via The Momentum Elevation or Momentum Meets Mastery websites or a designated third party payment processor of The Momentum Elevation or Momentum Meets Mastery choosing, in full.

b.) If Client elects to purchase One on One or Group coaching programs via one of the offered payment plans, Client agrees to abide by the rules and payments as explained on The Momentum Elevation or Momentum Meets Mastery sales pages. Client understands and agrees that following the first payment, subsequent payments will be automatically deducted utilizing the same mode of payment that was used to make the initial payment. Should Client fail to make timely payments, or if additional payments are not able to be processed, Client understands: (1) the remainder of the Program may be forfeited if payment is not made within six days of the date it is due, and (2) Client will owe a $200 late fee if he/she has not made the appropriate payment after the six day grace period. Client's decision to cease use of The Momentum Elevation or Momentum Meets Mastery for any reason does not eliminate Client's responsibility to complete the payment plan as agreed upon. Payment in full is required regardless of use, satisfaction with product, or results. The Momentum Elevation or Momentum Meets Mastery reserves the right to pursue collections using a dedicated collections agency for any outstanding amounts owed.

c.) For clients opting for the
3-month payment plan:

(1) Program end date: Although the Program content and coaching services end after 12 or 24 weeks, clients remain responsible for making all 3 payments as part of the payment plan agreement;

(2) Early pay option: At The Momentum Elevation and/or Momentum Meets Mastery sole discretion, clients may be offered the option to pay off the remaining balance of their payment plan in full at the original price of $3997 (for one one one coaching) and $1997 (for group coaching). This offer is optional and is at the discretion of The Momentum Elevation or Momentum Meets Mastery and may be communicated to clients during the Program.

d.) Client understands and agrees that his/her credit card used to make the initial payment in the payment plan will be automatically charged for each of the subsequent monthly payments thereafter, on or about the same date of the following month.

e.) The Momentum Elevation or Momentum Meets Mastery reserves the right to cancel Client's access to one on on or group coaching should he/she fail to make additional payments in accordance with the payment plan as agreed upon. Should this occur, Client understands she is not entitled to a refund of funds already issued to The Momentum Elevation and/or Momentum Meets Mastery in exchange for work completed thus far, and it is up to the sole discretion of The Momentum Elevation and/or Momentum Meets Mastery whether Client is to have continued access to any materials made available to Client during the Program up until payments were missed.

f) No refunds after revocation: In the event that access to the program is revoked due to missed payments, no refunds will be issued for payments already made. Additionally, the client will remain responsible for the remaining balance of the payment plan as agreed upon in the initial contract.

Refund Policy

One On One Coaching

a.) Momentum Elevation and Momentum Meets Mastery wholly believes in its product. It believes the methods work, but only if the Client is dedicated to the process. Nevertheless,

Momentum Elevation and Momentum Meets Mastery offer a conditional after 1st session money back guarantee if Client has completed the work to date, and does not believe the information completed is suitable for Client, or does not feel it works for Client. If Client is not completely satisfied with his/her purchase of One on One Coaching before the second session, Client may contact the support team at [email protected] prior to 11:59 pm PST before the second session. Any and all requests for refunds will be decided by the Momentum Elevation and Momentum Meets Mastery team and within Momentum Elevation's and Momentum Meets Mastery 's sole and exclusive discretion. If a refund is granted, Client can expect reimbursement thirty (30) days after cancellation of Program in the same manner in which payment was made. If a refund is not granted, Client understands he/she remains financially responsible for payment in full of Program, and as long as Client has received the full program, Client has no further recourse regarding refunds. Client understands he/she will forfeit any and all access to Program and benefits if a refund is issued.

b.) Following the second session window, all sales will be considered final, and The Momentum Elevation and Momentum Meets Mastery will not issue refunds for any reason. Please conduct any and all necessary research to determine if the coaching program is right for you prior to purchasing -- after the second session, all purchases are final, and Client is responsible for the full payment of all program fees, whether or not Client completes Program. If Client purchased Program with a payment plan, all payments must be made regardless of participation level.

Group Coaching

a.) Momentum Elevation and Momentum Meets Mastery wholly believes in its product. It believes the methods work, but only if the Client is dedicated to the process. Nevertheless,

Momentum Elevation and Momentum Meets Mastery offer a conditional 30-day money back guarantee if Client has completed the work to date, and does not believe the information completed is suitable for Client, or does not feel it works for Client. If Client is not completely satisfied with his/her purchase of Group Coaching within the first thirty (30) days after purchase, Client may contact the support team at [email protected] prior to 11:59 pm PST on the thirtieth day after Client purchased Group Coaching Program. Any and all requests for refunds will be decided by the Momentum Elevation and Momentum Meets Mastery team and within Momentum Elevation's and Momentum Meets Mastery 's sole and exclusive discretion. If a refund is granted, Client can expect reimbursement thirty (30) days after cancellation of Program in the same manner in which payment was made. If a refund is not granted, Client understands he/she remains financially responsible for payment in full of Program, and as long as Client has received the full program, Client has no further recourse regarding refunds. Client understands he/she will forfeit any and all access to Program and benefits if a refund is issued.

b.) Following this thirty (30) day window, all sales will be considered final, and The Momentum Elevation and Momentum Meets Mastery will not issue refunds for any reason. Please conduct any and all necessary research to determine if coaching Program is right for you prior to purchasing -- after the 30 day period, all purchases are final, and Client is responsible for the full payment of all program fees, whether or not Client completes Program. If Client purchased Program with a payment plan, all payments must be made regardless of participation level.

Voluntary Participation

a.) Client understands and agrees that they are voluntarily choosing to enroll in one on one or group coaching and is solely responsible for any outcomes or results. While The Momentum Elevation and Momentum Meets Mastery believes in its services and coaching programs are able to help many people, You as the Client acknowledge and agree that The

Momentum Elevation and Momentum Meets Mastery are not responsible nor liable to Client should Client sustain any injuries, incur harm, or encounter any negative ramifications. Client agrees that he/she is fully responsible for his/her health and well-being, including participation in one on one and group coaching programs and any results therein, and agrees that any decisions to implement strategies, tactics, and information contained within those programs are solely the responsibility and decision of Client.

b.) CLIENT BEHAVIOR: While Client is allowed to express his/her opinion and honest reviews regarding coaching programs, should Client make any false or disparaging comments within the Momentum Elevation and Momentum Meets Mastery "Communities" channels, social media accounts, or any other community or platform where Momentum Elevation and Momentum Meets Mastery students communicate, or otherwise publicly speak negatively about Momentum Elevation and Momentum Meets Mastery, Hovhannes Hunanyan or any other member of The Momentum Elevation and Momentum Meets Mastery, Client may be removed from the Momentum Elevation and Momentum Meets Mastery communities. The
Momentum Elevation and Momentum Meets Mastery place communities and positivity at the forefront of their brand, and in order to preserve community standards and experience for other members, a customer who cannot abide by this may lose his/her access to the community. Client understands that any extensive negativity or similar disruption to the communities in this way may result in removal from the Programs and all relevant communities, with NO REFUND.

Disclaimer

a.) The Momentum Elevation and Momentum Meets Mastery cannot guarantee results of One on One and Group Coaching programs, and cannot make any representations or guarantees regarding individual results. Client will hold The Momentum Elevation and Momentum Meets Mastery harmless if he or she does not experience the desired results, including but not limited to improving life.

b.) Earnings Disclaimer: The Momentum Elevation and Momentum Meets Mastery also does not make any guarantees or assurances regarding a particular financial outcome based on use of Program, nor is The Momentum Elevation and Momentum Meets Mastery responsible for Client earnings, or any increase or decrease in finances based upon information within Coaching Programs. Any information or testimonials regarding past or current clients' participation in Coaching Programs or working with The Momentum Elevation and Momentum Meets Mastery contained on Websites or in sales materials that contain financial information are individual, and results may vary. The Momentum Elevation and Momentum Meets Mastery are not able to learn and assess all clients' lives, businesses, personal strengths, and strategies outside Programs and as such, have no way of ensuring that Program will work or be applicable to all individuals or businesses. It is your job as the consumer to assess whether Program will be right or beneficial for you, and is in no way the responsibility of The Momentum Elevation and Momentum Meets Mastery, Hovhannes Hunanyan, or anyone else associated with The Momentum Elevation and Momentum Meets Mastery.

c.) Client understands that all services provided by The Momentum Elevation and Momentum Meets Mastery in connection with the Programs being purchased are provided on an "as is" basis, meaning it is without any guarantees, representations, or warranties, including but not limited to warranties relating to quality, non-infringement, fitness for a particular purpose, merchantability, or expectation or course of performance. Client is choosing to purchase this Program and work with The Momentum Elevation and Momentum Meets Mastery on a purely voluntary basis and does not hold The Momentum Elevation and Momentum Meets Mastery or Programs responsible should Client become dissatisfied with any portion of the Programs.

d.) Client agrees that he/she does not have a cause of action, legal remedy, and is not entitled to a refund should he/she not achieve the results desired following completion of the program, as long as The Momentum Elevation and Momentum Meets Mastery delivers the Programs or similar substitutes, upon additional agreement by The Momentum Elevation and Momentum Meets Mastery and Client.

e.) Client agrees to hold The Momentum Elevation and Momentum Meets Mastery harmless should any physical, emotional, or financial injury occur as a direct or indirect result of use of Coaching Programs. The content provided by The Momentum Elevation and Momentum Meets Mastery on his/her website and within Coaching Programs are comprised of information that has worked for The Momentum Elevation and Momentum Meets Mastery and other clients, and may or may not be useful to Client in his/her personal business or life. Client understands The Momentum Elevation and Momentum Meets Mastery cannot guarantee results from this Program, and has no expectation of a specific result that he or she holds The Momentum Elevation and Momentum Meets Mastery responsible for.

All products and services by our company are for educational and informational purposes only. Your level of success in attaining any stated ideas or strategies in our programs or on our websites or live casts is dependent upon a number of factors including your health, skill, knowledge, ability, dedication, goals, relationships, love of other humans, and financial situation, to name a few. Because these factors differ according to individuals, we cannot guarantee your specific success or results in any area of life or any endeavor. All information, resources, training, education, modules, and other opinions provided by guest experts will be solely their own, based upon their education and experience, and are not necessarily a reflection of the opinions of The Momentum Elevation and Momentum Meets Mastery. Client agrees to indemnify and hold The Momentum Elevation and Momentum Meets Mastery harmless from any and all claims relating to material or information provided by a guest expert - any issues Client may have with a guest expert must be taken up with the guest expert directly.

2. MEMBERSHIP SITE OUTLINE

By checking the box next to this Terms of Use, and clicking the “Purchase” button, you, the purchaser of a subscription to the Membership Site entitled (hereinafter “Client”) acknowledge the terms as outlined herein, and agree and willingly purchase entry into The Membership to be provided with services rendered by The Momentum Elevation and Momentum Meets Mastery, and you agree you are voluntarily entering into a legally binding Agreement, including the automatic renewal terms, with Momentum Elevation and Momentum Meets Mastery, inclusive of the following terms and conditions mutually agreed upon:

For good and valuable consideration of thirty-seven U.S. dollars ($37) Client has agreed to purchase a monthly subscription to The Membership or an annual subscription of three-hundred and seventy US dollars ($370). Promotional terms may apply and are outlined on the checkout page during these promotional periods. If Client was gifted a membership, he/she/they confirm this agreement still represents a bargained-for exchange, and understand they are legally bound to this Agreement. In exchange, Momentum Elevation and Momentum Meets Mastery agrees to provide the services outlined in the Membership Site Details below.

a.) Client agrees and understands that he/she is purchasing a subscription to Momentum Elevation or Momentum Meets Mastery, offering educational resources, group mentoring calls, and a community of like-minded individuals.

b.) Client acknowledges that he/she has conducted any additional research necessary to feel he/she understands what is being provided in The Momentum Elevation or Momentum Meets Mastery as well as what is not included. Client agrees to be bound by the terms and conditions outlined herein, as well as the general policies and procedures that can be found in this Agreement and on Momentum Elevation or Momentum Meets Mastery websites.

c.)The Momentum Elevation and Momentum Meets Mastery are not to be considered a substitute for personalized business, medical, or legal advice. The Momentum Elevation is not designed to treat any mental, emotional, or other medical conditions. If you as the Client believe you may be in need of personalized attention, whether for your business, health, or otherwise, please seek additional assistance outside The Momentum Elevation or Momentum Meets Mastery.

Promotions and Bonuses

a. The Momentum Elevation and Momentum Meets Mastery may offer promotions, bonuses, or other offers from time to time in connection with The membership, promoting one or more aspects of The membership, or offering new or current members additional offers in exchange for upgrading to annual membership, or taking any other action as decided by The Momentum Elevation or Momentum Meets Mastery. Any promotion which offers new or additional products or services may include additional terms and conditions that must be agreed to prior to becoming eligible for any such promotion or offering. Should Client enter into The Membership as a new member through any such promotion, bonus, or other offering, such Client will agree to these Terms of Use, as well as any additional terms and conditions associated with the promotion or bonus.

b. The Momentum Elevation or Momentum Meets Mastery also reserves the right to increase or decrease the price of The Membership for future launches, and/or edit the deliverables, and that the price for current members may increase in the future, in the sole and absolute discretion of The Momentum Elevation or Momentum Meets Mastery.

Confidentiality

a. Client understands he or she is purchasing a subscription to The Momentum Elevation or Momentum Meets Mastery. Following Client's purchase and access to The Membership, Client will have gained access to various materials and personal intellectual property of Momentum Elevation or Momentum Meets Mastery, including but not limited to materials such as verbal, written, and video advice, mindset guidance, and/or other information that may become available for use through Client's participation in The Membership. Client understands and acknowledges that this information is not to be openly shared with others who have not purchased a membership to The Momentum Elevation or Momentum Meets Mastery. Client agrees not to share, copy, or distribute any documents or other proprietary information obtained through The Membership, and agrees that he or she will be in violation of these Terms of Use if he or she uses any of the Content outlined as his/her own material, or repurposes and uses the Content in his/her own business without express written permission of Momentum Elevation or Momentum Meets Mastery.

b. Should Client breach this provision and disclose confidential or proprietary information belonging to Momentum Elevation or Momentum Meets Mastery or another participating in The Membership, Client understands additional action may be taken by Momentum Elevation or Momentum Meets Mastery up to and including legal action.

Testimonials

a. The Momentum Elevation or Momentum Meets Mastery may request Client provide a testimonial to be published on The Momentum Elevation or Momentum Meets Mastery websites, or on various sales materials for The Membership or another Program created by The Momentum Elevation or Momentum Meets Mastery. Client understands that he or she is not required to give any testimony, and understands that the choice to do so is freely up to Client. There will be no ramifications or change in relationship between The Momentum Elevation or Momentum Meets Mastery and Client if Client refuses testimonial.

b. If Client accepts and provides The Momentum Elevation or Momentum Meets Mastery with a testimonial, Client understands the material, along with a photo of Client, will likely be published on The Momentum Elevation or Momentum Meets Mastery websites or otherwise. Should Client agree to provide a testimonial, Client will agree to review and sign an additional Release, confirming same, and confirming The Momentum Elevation's or Momentum Meets Mastery's rights to use Client's testimonial. No payment or additional services will be provided in return for Testimonial, and Client understands he or she is granting The Momentum Elevation and Momentum Meets Mastery an unlimited, irrevocable license in perpetuity to use, publish, distribute, or repurpose any information provided to The Momentum Elevation or Momentum Meets Mastery as part of a Testimonial.

c. Client gives The Momentum Elevation or Momentum Meets Mastery an unlimited, irrevocable license to repost, share, publish, and otherwise use the text, name, and/or likeness of Client which client voluntarily posts to social media or sends in via email, including but not limited to The Membership Facebook group, The Momentum Elevation or Momentum Meets Mastery Facebook Page, Instagram comments, Instagram DMs to The Momentum Elevation or Momentum Meets Mastery, or Hovhannes Hunanyan. Client understands and agrees any such comments or messages sent or posted by Client may be captured and reposted by The Momentum Elevation or Momentum Meets Mastery in any capacity it sees fit, including but not limited to sharing in email marketing, reposting to the public on social media, and otherwise sharing the comment with the public in an effort to publicize and market for The Membership.

Payment and payment plans

a. Client understands the cost of The Membership is payable monthly, in the amount of thirty-seven U.S. dollars ($37), or annually, in the amount of
three-hundred and seventy U.S. dollars ($370) and charged automatically by month or year, in accordance with the Auto-Renewal Terms outlined below paragraph. Client understands he/she is responsible for the full payment each month or year, and agrees to pay the sum requested electronically, via The Momentum Elevation or Momentum Meets Mastery website or a designated third-party payment processor of The Momentum Elevation's or Momentum Meets Mastery's choosing, in full. If Client has joined The Membership during a promotional period and has been promised a trial period that is less than the amount outlined above, Client understands that after such trial period, Client will be charged the regular retail cost, for a monthly or annual membership; whichever Client selects.

b. Should Client fail to make timely payments, or if additional payments are not able to be processed, Client understands Client's access to The Membership may be restricted if payment is not made within 1 day of the date it is due. If payment is not made on the date it is due, The Momentum Elevation or Momentum Meets Mastery will continue to attempt to charge Client via the membership site software; if and when payment goes through, Client will again receive full access to the membership site. If payment is not collected, Client's access will remain restricted, and Client will carry a balance on her account, showing the months) owed. Client must bring her account completely current in order to be granted access. If payment continues to be unsuccessful after sixty (60) days, Client membership shall be revoked and permanently cancelled. Should Client wish to rejoin The Membership, after this period, she must do so at the current price membership is being offered, which The Momentum Elevation or Momentum Meets Mastery reserves the right to increase at any time for future launches.

c. The Momentum Elevation or Momentum Meets Mastery reserves the right to cancel Client's access to The Membership should he/she fail to make additional payments in accordance with the Auto-Renewal Terms as outlined below. Should this occur, Client understands she is not entitled to a refund of funds already issued to The Momentum Elevation or Momentum Meets Mastery for access to The Membership.

GIFTED MEMBERSHIPS. From time to time, The Momentum Elevation or Momentum Meets Mastery may offer current clients the opportunity to gift an annual membership. If Client elects to gift a membership, he/she/they understand that agreement to these Terms of Use will apply to their gifted membership as well, regarding payment, refunds, and the terms and conditions outlined in this section.

i. All gifted memberships will be sold as final sale, with no refunds available once purchase has been completed.

ii. Client may only gift an annual membership; monthly memberships will not be available to gift.

iii. Client MUST gift the membership within six (6) months of the date of purchase, or he/she/they will lose the gifted membership, and will not receive a refund.

iv. Client will not be automatically billed or charged for the gifted membership, only his/her/their own membership.

RECIPIENTS OF GIFTED MEMBERSHIPS. If you as the client are the recipient of a gifted membership to The Membership, you understand and agree to these Terms of Use in full, and specifically the foregoing:

i. Client will have six (6) months from the date of receipt to activate and begin using your membership to The Membership, or it will be deactivated, and no longer available for use.

ii. Client will receive notification via email of their gifted membership, and must create an account in order to activate a membership into The Membership, which includes providing The Momentum Elevation or Momentum Meets Mastery with a credit card to keep on file for future automatic billing.

iii. Following the term of the gifted membership, Client's card will be charged the current annual membership rate. If Client wishes to cancel the membership or update his/her/their membership to monthly, Client may do so by contacting The Momentum Elevation or Momentum Meets Mastery at hovhannes@momentumelevation.com and follow the cancelation instructions below.

iv. By creating an account and using The Membership, you as the Client confirm you have read and agree to these Terms of Use in full. By continuing to use The Membership, you continue to agree to these Terms of Use in their most updated form.

Auto-renewal agreement

a. Client understands and agrees that continued access to The Membership requires recurring monthly or recurring annual payments that will be made by Client on the day of the month or year on which they signed up.

b. If Client elects to be charged monthly: by purchasing access to The Membership, and agreeing to these Terms of Use, Client understands he/she will be automatically charged each month via the same card or manner in which the initial payment was made, for the following month of the Membership. This process will repeat each month unless and until Client properly cancels his or her membership. If Client elects to be charged annually: by purchasing access to The Membership, and agreeing to these Terms of Use, Client understands he/she will be automatically charged each year via the same card or manner in which the initial payment was made, for the following year of The Membership. This process will repeat each year unless and until Client properly cancels his or her membership

c. CANCELLATION POLICY: If Client wishes to cancel his or her membership, Client must do so more than 24 hours before the charge is scheduled to withdraw. Any requests for cancelation made less than 24 hours before the automatic renewal is scheduled to charge Client's card, or made subsequent to the charge, will take effect the following month.

i. HOW TO CANCEL: In order to cancel a membership, Client must send an e-mail to [email protected] with the subject line MEMBERSHIP CANCELATION, including the Client's name, email address, and confirmation of request to terminate his or her membership. Client will be notified upon The Momentum Elevation or Momentum Meets Mastery receipt of email, and his or her membership will subsequently be canceled prior to the following billing period, assuming it is more than 24 hours away.

ii. As outlined above, if Client cancels his or her membership less than 24 hours before the automatic renewal is scheduled to charge Client's card, Client acknowledges and agrees he or she will be charged for the next month (or year, if billed annually), and the cancelation will take effect following this. Should this occur, Client will have access to The Membership for the month (or year) in which Client paid, with membership terminating at the end of the last paid month/year.

d. If Client purchased access to The Membership during a period in which a free months), or trial period was granted, Client understands he or she will be automatically charged the full monthly amount following the end of the trial period. Any failure by Client to keep such address updated may impact The Momentum Elevation's or Momentum Meets Mastery's ability to provide Client with accurate billing updates and notices. Client understands this, and to the fullest extent permitted by law, acknowledges that it will be Client's responsibility to notify The Momentum Elevation or Momentum Meets Mastery of any changes to his/her/their billing address, and represents that the billing address listed within Membership shall be the most updated and accurate address for Client, and the state of residency for Client. To the extent Client's physical residency is different from his/her/their billing address, Client confirms he/she/they will notify The Momentum Elevation or Momentum Meets Mastery of same, to ensure The Momentum Elevation or Momentum Meets Mastery always has Client’s most current address.

Refund Policy

The Momentum Elevation and Momentum Meets Mastery wholly believes in its product. It believes the methods work, but only if the Client is dedicated to the process. Nevertheless,

However, if business partners decide to share an account only one individual will be granted access to the Facebook group, and emails will be sent to one email address only.

Voluntary Participation

a. Client understands and agrees that he/she is voluntarily choosing to enroll in The Membership and is solely responsible for any outcomes or results. b. Client also understands she will have the opportunity to provide The Momentum Elevation and Momentum Meets Mastery with additional personal information, viewable to all The members, including but not limited to location, industry, and other information. All information is completely voluntary and optional to complete, and Client does not gain or lose anything in The Membership for choosing to complete or not complete the additional information. If unable to reach a resolution informally, Client and The Momentum Elevation or Momentum Meets Mastery agree that all disputes will be submitted for Arbitration by the American Arbitration Association, to be completed in Los Angeles, California within a reasonable amount of time. Client and The Momentum Elevation or Momentum Meets Mastery agree to participate in the arbitration process in good faith and in a manner that will effectively and efficiently resolve the dispute at hand, including the exchange of any materials, documents, or information. The decision made by the arbitrator is to be final and binding on both parties, and is not to be appealed or otherwise set aside. It is to be enforceable in any court of proper jurisdiction as a judgement of law or decree.

APPLICABLE LAW

This Agreement shall be governed by and under control of the laws of California regardless of conflict of law principles, and regardless of location of Client. Client understands this and agrees that the laws of California are to be applicable here.

INTELLECTUAL PROPERTY

Client agrees and understands that The Momentum Elevation and Momentum Meets Mastery has created numerous original, creative works in connection with The Membership and other programs, and agrees that The Momentum Elevation and Momentum Meets Mastery maintains all copyrights and other intellectual property rights in all original or derivative content associated with or included in The Membership or other products, whether created prior to working with Client or specifically for Client, including but not limited to: documents, charts, emails, graphs, products, systems, processes, handouts, worksheets, and any other original work created by The Momentum Elevation and Momentum Meets Mastery. Client agrees she may be granted a limited right to use selected materials in the course of his or her own business but understands that the original proprietary rights remain with The Momentum Elevation and Momentum Meets Mastery.
